CONSTITUTION
| 1. NOM | 1. NAME |
| 1.1 Le nom de l’Association est « International Formula 18 Class Association » (« IF18CA »). | 1.1 The name of the Association shall be “International Formula 18 Class Association” (“IF18CA”). |

| (a) promouvoir et développer les courses de Formule 18 selon des règles uniformes dans le monde entier ; et (b) fournir une structure pour la gestion de la classe et pour l’échange d’informations entre les pratiquants de Formule 18 afin d’améliorer le niveau de pratique de ces catamarans. | (a) to promote and develop Formula 18 class racing under uniform rules throughout the world; and (b) to provide a structure for class management and for the exchange of information among Formula 18 sailors to enhance the enjoyment of these catamaran sailboats. |

| 5.1 Tout membre en règle d’une Association de Classe Nationale, qui est également en règle avec le Conseil Mondial (une « ACN Membre »), est membre de la IF18CA. | 5.1 Every member in good standing of a National Class Association, which is also in good standing with the World Council (a “Member NCA”), shall be a member of the IF18CA. |

| 6.1 Tout pays peut, sur demande adressée au Secrétaire Général du Conseil Mondial, se voir attribuer la qualité d’ACN Membre à condition de satisfaire aux conditions d’adhésion au Conseil Mondial suivantes : | 6.1 Any country may, upon application to the Secretary General of the World Council, be granted a charter as a Member NCA provided it satisfies the following requirements of membership to the World Council: |
| (a) avoir formé une Association Nationale de Classe dûment constituée, reconnue par l’Autorité Nationale de son pays, pour le développement des Formule 18 dans ledit pays ; (b) compter au moins (4) quatre membres inscrits dans ce pays ; (c) avoir un comité dûment élu, comprenant autant de membres que jugé nécessaire ; et (d) qu’aucune autre association de classe nationale ne soit déjà accréditée dans son pays auprès du Conseil Mondial. | (a) that it has formed a duly constituted National Class Association, recognised by their country’s National Authority, for the development of racing Formula 18s within the country; (b) that there are not less than (4) four members registered in that country; (c) that it has a duly elected committee, including such officers as it shall determine necessary and requisite; and (d) that there is no other National Class Association in their country already accredited to the World Council. |
| 7. ADMISSION | 7. NATIONAL APPLICATIONS |

| 7.4 Les membres du Conseil Mondial sont liés par les présents statuts et ses amendements dûment adoptés et se conforment à toutes les résolutions et règlements pris conformément à la présente Constitution. Les ACN Membres font de leur mieux pour s’assurer que les membres se conforment également à ces résolutions et directives. | 7.4 The members of the World Council shall be bound by this Constitution, and duly enacted amendments thereto and shall comply with all resolutions and regulations made in accordance with this Constitution. Member NCAs shall use their best endeavours to ensure that individual members also comply with such resolutions and directions. |
| 7.5 Un membre cesse d’être membre : i) pendant toute période postérieure à trois (3) mois de la date d’échéance du paiement à l’égard de laquelle il n’a pas payé sa souscription ou autres sommes dues au Conseil Mondial ou ii) à la réception de sa démission par le Bureau Exécutif. Cette adhésion peut être renouvelée avec effet immédiat par le paiement de cotisations en souffrance ou d’autres sommes dues au Conseil Mondial. | 7.5 A member shall cease to be a member: i) during any period after three (3) months of the payment due date in respect of which they have not paid their subscription or other monies due to the World Council or ii) upon receipt of notice of their resignation by the Executive Committee. Such membership may be renewed with immediate effect by payment of outstanding dues or other monies owing to the World Council. |

| 9. CONSEIL MONDIAL ET ASSEMBLÉE GÉNÉRALE | 9. WORLD COUNCIL AND ANNUAL MEETING |
| 9.1 Le Conseil Mondial se compose des membres du Bureau Exécutif et d’un représentant de chaque ACN Membre. | 9.1 The World Council shall consist of the members of the Executive Committee and of one representative of each Member NCA. |
| 9.2 L’assemblée Générale du Conseil Mondial se tiendra chaque année à l’endroit et au moment que le Bureau Exécutif jugera les plus commodes pour la majorité des membres. Cette réunion doit : | 9.2 A meeting of the World Council (the “Annual Meeting”) shall be held annually in such place and time as the Executive Committee may consider most convenient to the majority of the members. | 14.1 Le Conseil Mondial nommera un Comité technique composé d’un Président, du Chef Jaugeur, et jusqu’à six (6) autres membres. La fonction de Chef Jaugeur peut être combinée à celle de Président ou de membre du Comité Technique. | 14.1 The World Council will appoint a Technical Committee consisting of a Chairman, the Chief Measurer and up to six (6) other members. The role of Chief Measurer can be combined with the role of Chairman or member of the Technical Committee. |
| 14.2 Le Comité technique a les fonctions suivantes : (a) conseiller le Conseil Mondial et le Bureau Exécutif sur toute question technique pertinente à la classe. (b) en collaboration avec le Département Technique de World Sailing, pour s’assurer que le contrôle de la classe est correctement exercé, conformément aux règles de classe. (c) d’enquêter sur toute demande d’un propriétaire de bateau concernant la conception ou les spécifications de ce bateau, et de faire rapport au Bureau Exécutif. (d) consulter les constructeurs et les fabricants d’équipement sur tout développement du bateau ou de l’équipement jugé souhaitable en raison de l’expérience en navigation. (c) to investigate any query by a boat owner regarding the design or specification of this boat, and to report to the Executive Committee. (d) to consult with builders and equipment manufacturers on any development of the boat or equipment deemed to be desirable as a result of sailing experience. (e) to ensure that the boats used in World and Continental Championships and major regattas comply with the Class Rules. |
| 15. RESSOURCES | 15. FINANCIAL MATTERS |
| 15.1 L’association est financée par : i) Les cotisations des ACN Membres ; ii) Une part des droits de construction payés sur chaque bateau ; iii) Tout autre revenu négocié et accepté par le Bureau Exécutif. | 15.1 The association shall be funded by: i) Subscriptions from Member NCAs; ii) A share of the building fee paid on each boat; iii) Any other revenue negotiated and accepted by the Executive Committee. |
| 15.2 Les exercices financiers de l’IF18CA s’étendent du 1 janvier au 31 décembre. | 15.2 IF18CA’s subscription years shall run from 1 January to 31 December. |
| 15.3 Les ACN Membres paient une cotisation pour chaque membre adhérent de leur Association. Ces cotisations sont payables avant la fin février de l’année en cours, sur la base des cotisations perçues au cours de l”année budgétaire précédente. Le montant de la cotisation payable par les ACN Membres à l’IF18CA est fixé par le Conseil Mondial. | 15.3 Member NCAs shall pay a subscription for each paid up member of their Association. These subscriptions shall be payable by the end of February based on the total membership fees received the previous calendar year. | (a) S’il est donné par voie postale, il est réputé avoir été donné le septième jour suivant la date à laquelle le Secrétaire Général aura adressé cet avis par courrier aérien ou urgent à la personne ou à l’organisme concerné à l’adresse indiquée pour cette personne ou cet organisme dans les registres de la IF18CA, que ce courrier ait été ou non effectivement reçu par la personne ou l’organisme concerné dans ce délai, (b) S’il est donné par communication électronique, l’avis est réputé avoir été donné 24 heures après que le Secrétaire Général a expédié avec succès la communication électronique écrite dont l’avis fait l’objet, qu’il ait ou non été de fait reçu dans ce délai par la personne ou l’organisme concerné. | 19.1 Un membre ou une personne d’une ACN Membre ne peut être suspendu ou révoqué par le Bureau Exécutif qu’après une audience protégeant son droit à l’application régulière de la loi, y compris un échange mutuel de preuves avant l’audience. | 19.1 A member, or individual of a Member NCA, may be suspended or removed from membership by the Executive Committee only after a hearing protecting his rights to due process including a mutual exchange of evidence prior to the hearing. |
| 19.2 Un membre peut être suspendu ou révoqué pour ce qui suit : (a) commettre un acte illégal à l’égard de l’IF18CA ou de l’un de ses membres ; (b) pour toute conduite non sportive contraire à l’intérêt des membres de la IF18CA ; ou (c) pour violation intentionnelle des règles de classe. | 19.2 A member may be suspended or removed for the following: (a) committing an unlawful act in relation to the IF18CA or one of its members; (b) for any unsportsmanlike conduct contrary to the interest of the members of the IF18CA; or (c) for intentional violation of Class Rules. |

| 21.1 Les Dirigeants ainsi que les membres du Comité technique et du Comité d’audit ne seront pas tenus d’exercer l’une ou l’autre des missions qui leur sont demandées par le présent règlement si le Conseil Mondial n’est pas en mesure de couvrir les coûts et les dépenses liés à ces actions. | 21.1 The Officers and members of the Technical Committee and Audit Committee shall not be obliged to do any of things required of them by these rules if the World Council shall not reasonably be expected to be in funds sufficient to pay their reasonable cost and expenses by the time these costs and expenses are estimated to come due. |
| 21.2 Dans l’exercice des pouvoirs et des fonctions qui leur sont conférés par la présente constitution, aucun Dirigeant ou membre du Comité technique ou du Comité de vérification ne pourra être tenu responsable des pertes subies par l’un quelconque des membres ou anciens membres du Conseil Mondial ou des biens du Conseil Mondial en raison de toute erreur ou omission commise de bonne foi par lui-même ou un autre dirigeant ou membre du Bureau Exécutif ou pour toute autre affaire autre que l’omission ou la fraude intentionnelle ou individuelle d’un acte répréhensible de la part de la personne recherchée. | 21.2 In the execution of their powers and duties under this constitution no Officer or member of the Technical Committee or Audit Committee shall be liable for any loss to any of the members or former members of the World Council or to the assets of the World Council by reason of any mistake or omission made in good faith by him or any other officer or member of the Executive Committee or for any other matter other than wilful and individual wrongdoing omission or fraud on the part of the person who is sought to be made liable. |

| 22.1 La dissolution ne peut être prononcée qu’à l’occasion d’une Assemblée Générale Extraordinaire spécialement convoquée à cet effet. L’Assemblée Générale Extraordinaire qui statue sur la dissolution nomme un ou plusieurs liquidateurs, et décide de la dévolution de l’actif net, s’il y a lieu, à un ou plusieurs organismes à but non lucratif ayant des buts similaires. | 22.1 Dissolution may only be pronounced by an Extraordinary Meeting convened especially for this purpose. The Extraordinary Meeting pronouncing dissolution shall appoint one or more liquidators and decide on the distribution of the assets and liabilities, if any, to one or more non-profit organisations with similar purpose. |

| 23.2 Les décisions du Bureau Exécutif sont définitives en matière de gestion du Conseil Mondial, sauf à être contestées formellement par écrit par tout membre ou groupe de membres du Conseil Mondial. | 23.2 The decision of the Executive Committee shall be final in matters of the management of the World Council and only if the actions or decisions of the Executive Committee are disputed formally in writing by any member or group of members of the World Council. |
